Inpatient physiotherapy services provided within Eastwood Private Hospital are delivered under separate contractual arrangements with the hospital and are governed by a separate service agreement. These Website Terms & Conditions apply to outpatient services and use of this website only.

6. Gym Membership – Eastwood Private Hospital Staff, Tenants and Contractors

Gym membership access is available to eligible Eastwood Private Hospital staff, tenants and contractors, subject to approval.

Gym access:

• Is unsupervised

• May be available 24 hours per day, subject to hospital access conditions

• Is conditional upon completion of a Gym Membership Agreement and Liability Waiver

All members must sign a separate Gym Membership Agreement and Waiver before being granted access. That agreement outlines:

• Conditions of use

• Health declarations

• Risk warnings

• Liability limitations applicable to gym use

Access will not be provided without a signed agreement.

Use of gym facilities involves inherent risks associated with physical exercise. Members use the facilities at their own risk, subject to the terms of their signed agreement.

We reserve the right to suspend or terminate gym access at our discretion.

7. Limitation of Liability

To the maximum extent permitted by law:

• We exclude liability for any loss, damage or injury arising from use of this website.

• We exclude liability for reliance on information published on this website.

• We are not liable for indirect, incidental or consequential loss.

Nothing in these Terms excludes, restricts or modifies any consumer rights under the Australian Consumer Law that cannot lawfully be excluded.

8. Recreational Services Notice

Participation in physical exercise and use of gym facilities may constitute “recreational services” under the Competition and Consumer Act 2010 (Cth).

Liability for recreational services may be limited in accordance with applicable legislation and as set out in the signed Gym Membership Agreement and Waiver.
